Important: MXRevv is a live group riding companion for lawful, organised rides. It is not a racing app and does not encourage illegal driving of any kind. By using MXRevv, you agree to operate your vehicle in full compliance with all applicable traffic laws.

1. Acceptance of Terms

By accessing or using MXRevv (the "Service"), including the website at www.mxrevv.com and any associated mobile applications, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms in their entirety, you must not access or use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and MXRevv ("Company", "we", "us", "our"). Your continued use of the Service following any update to these Terms constitutes acceptance of the revised Terms.

2. Description of Service

MXRevv is a live group riding companion application designed for lawful, organised group rides including car meets, motorcycle convoys, scooter rides, and similar enthusiast gatherings on public roads ("Rides").

MXRevv provides real-time location sharing, a cinematic heads-up display (HUD), group session management, and crew coordination features solely for the purpose of enhancing the social and organisational experience of lawful group rides.

MXRevv is NOT a racing application, speed competition platform, or tool intended to encourage, facilitate, or reward illegal driving behaviour of any kind. Any features displaying speed or position are provided as informational session data for group coordination purposes only, equivalent to information available on a standard vehicle dashboard.

3. Eligibility

You must be at least 18 years of age, or the minimum legal age in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement.

You must hold a valid licence to operate the vehicle you use during any Ride. Use of the Service while operating any vehicle without proper authorisation, licensing, or insurance is strictly prohibited and constitutes a material breach of these Terms.

4. Lawful Use & Prohibited Conduct

You agree to use the Service exclusively in compliance with all applicable local, state, national, and international laws and regulations, including but not limited to traffic laws, road safety laws, and vehicle licensing requirements.

You expressly agree NOT to:

(a) Use the Service to organise, participate in, or encourage illegal street racing, speed contests, or any activity that violates traffic laws;

(b) Use speed or position data displayed within the Service to compete illegally with other road users;

(c) Use the Service while operating a vehicle in a manner that endangers yourself, your passengers, other road users, or the general public;

(d) Use the Service to harass, threaten, or harm other users or third parties;

(e) Misrepresent your location, identity, or vehicle type within the Service;

(f) Circumvent, disable, or interfere with any safety features or restrictions within the Service;

(g) Use the Service in any way that violates the rights of others or applicable law.

Violation of this section may result in immediate termination of your account and, where appropriate, reporting to relevant law enforcement authorities.

5. Location Data & GPS Tracking

The Service requires access to your device's location services to function. By using the Service, you expressly consent to the collection, processing, and sharing of your real-time and historical location data as described herein.

Location data is collected: (a) in real-time during active group sessions you have joined or created; (b) for the purpose of displaying your position on the group session map visible to other session participants; and (c) to provide speed, heading, and position data within the session HUD.

Your location data during an active session is shared only with other participants in the same session who have joined using a valid session code. Location sharing is active only while a session is running. You may leave a session at any time, which will immediately cease sharing your live location with other participants.

We may retain anonymised, aggregated location data to improve Service performance, analyse city-level usage patterns, and develop new features. This aggregated data cannot be used to identify you individually.

You are solely responsible for ensuring that real-time location sharing is appropriate and safe given your circumstances. Do not use the Service if location sharing poses a risk to your personal safety.

6. User Profile & Account Data

To use the full features of the Service, you may be required to create a user profile ("Account"). You agree to provide accurate, current, and complete information during registration and to keep your Account information updated.

Your Account data, including your display name, vehicle type, and profile preferences, is visible to other users within sessions you participate in. You are responsible for all activity that occurs under your Account.

You must not share your Account credentials with others. You are responsible for maintaining the confidentiality of your login information and must notify us immediately of any unauthorised use of your Account.

We collect and process Account data in accordance with our Privacy Policy, which is incorporated by reference into these Terms.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) location data or speed data displayed will be accurate, real-time, or reliable for any safety-critical purpose; (c) the Service will be available in any particular location or jurisdiction.

GPS and location data are subject to signal interference, device limitations, and network conditions. You must not rely on the Service for navigation, emergency response, or any safety-critical purpose.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MXREVV, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR: personal injury or death; property damage; loss of data; loss of revenue or profits; road traffic accidents, collisions, or incidents occurring during or related to use of the Service; actions or decisions made by you or others based on information displayed within the Service.

YOU EXPRESSLY ACKNOWLEDGE THAT MXREVV IS A GROUP COORDINATION TOOL ONLY. ALL DECISIONS REGARDING VEHICLE OPERATION, SPEED, ROAD CONDITIONS, AND SAFETY ARE SOLELY YOUR RESPONSIBILITY. THE SERVICE DOES NOT CONTROL, DIRECT, OR INFLUENCE YOUR DRIVING BEHAVIOUR.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential damages, our liability shall be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless MXRevv and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any road traffic incident, accident, or injury occurring during or related to your use of the Service; (e) any claim by a third party arising from your conduct during a Ride.

10. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the MXRevv name, logo, HUD design, software, text, graphics, and data compilations — are the exclusive property of MXRevv and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

11. Termination

We reserve the right to suspend or terminate your access to the Service immediately and without notice if we determine, in our sole discretion, that you have violated these Terms or applicable law.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination — including but not limited to Sections 7, 8, 9, and 12 — shall survive.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.

You agree that any claim must be brought in your individual capacity and not as a class action or representative proceeding.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by notifying you through the Service or by email.

Your continued use of the Service after any modification constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must cease using the Service immediately.
